Vitrified clay is still a permitted building sewer material in New York today, listed in the residential code alongside cast iron, PVC and polyethylene, so finding clay on a survey is not by itself a reason to replace anything; finding a run of clay whose joints have opened along its length is. Weigh the connection rule too, because if a public sanitary sewer sits within 100 feet of your lot line and the village has served notice, the code requires an owner to install the plumbing and connect at their own expense within 180 days. That is a deadline you would rather plan for than react to.

Clay is not automatically condemned

If the fault is not in the public sewer the department refers the property to a licensed plumber or drain service. There is no direct charge for the visit and the homeowner does not need to be present.

Table P3002.2 of the New York residential code lists the pipe materials permitted for a building sewer today. Vitrified clay pipe to ASTM C425 and ASTM C700 is still on that list, as are concrete pipe, cast iron, ABS, PVC, polyethylene, polyolefin, copper and stainless steel. Bituminized fiber pipe appears nowhere on it.

Village of Liverpool Code section 295-1 requires the owners of all houses and buildings used for human occupancy in the Village, abutting a street with a public sanitary sewer, at their own expense to install plumbing and connect directly to the public sewer within 180 days of official notice, provided the public sewer is within 100 feet of the property owner's lot line. Section 295-5 describes the system by reference to drawings entitled Village of Liverpool, New York, Sanitary Sewer Details, dated January 1930.
