The Fayetteville code clause that names tree roots
Village code section 133-13 is unusual and it is useful. It specifies extra-heavy cast-iron soil pipe for the building sewer, permits Transite or equal asbestos-cement pipe where the Superintendent approves it, and says cast iron with leaded joints may be required where the building sewer is exposed to damage by tree roots, which makes Fayetteville the one municipality here that treats roots as a design condition rather than as bad luck. Two things follow for a homeowner. First, roots are not attacking a sound pipe at random. Water Environment Protection explains that they grow toward moisture, find it at a leaking joint or a crack, then intrude and multiply until they clog the pipe and can eventually crack it, which is why cutting them without repairing the joint only resets the clock. Second, an older Fayetteville lateral may be asbestos-cement, and New York Industrial Code Rule 56 treats more than twenty-five linear feet of asbestos containing material as a small asbestos project requiring a contractor holding an asbestos handling license from the Commissioner. Establish the material before a saw touches it. Section 133-14 sets a minimum four inch inside diameter at not less than a quarter inch per foot of fall, and section 133-17 prohibits connecting roof downspouts, exterior foundation drains or areaway drains to a building sewer at all, which matters here because the county is under a state Order on Consent to find and reduce inflow and infiltration in this basin. On water, the village record is refreshingly narrow: the hazard annex names Limestone Creek, flowing north through the western portion of the Village, as its flood exposure, and records no unique vulnerability from severe or winter weather beyond the county norm. West of the creek, groundwater is a live factor in a drain diagnosis. East of it, much less so.

WEP states that tree roots are naturally inclined to grow toward moisture and that a sewer line gives them all the moisture they need, that roots can intrude and then continue to grow and multiply until they clog the sewer pipe, and that they can eventually crack it. The department's advice is to be mindful of where the sewer line runs before planting.

New York Industrial Code Rule 56 defines an asbestos project as work involving the removal, encapsulation, enclosure, repair or disturbance of friable or non-friable asbestos, or any handling of asbestos material that may release fibers. A small asbestos project is more than 25 and less than 260 linear feet of asbestos containing material; a minor project is 25 linear feet or less. Section 56-3.1 forbids any contractor from engaging in an asbestos project without a valid asbestos handling license from the Commissioner, and section 56-1.4 requires the asbestos contractor to tell every other contractor on site that disturbance by anyone else is prohibited. Section 56-1.3 exempts only owner-occupied single family dwellings where the owner performs the work.

The Village of Fayetteville annex to the 2025 county hazard mitigation plan records that Limestone Creek flows north through the western portion of the Village and is vulnerable to flooding. The same annex records that the Village has no unique vulnerability or impact from severe weather or from winter weather beyond the county norm.

WEP states that its right-of-way maintenance and condition assessment work along the Bishop Brook Trunk Sewer supports compliance with an Order on Consent between Onondaga County and the New York State Department of Environmental Conservation which requires investigation and reduction of inflow and infiltration sources. Clearing along the county's 25 foot wide right-of-way ran from January 12 to the end of March 2026, and a closed-circuit television crew is inspecting manholes and sewer lines for condition and signs of inflow and infiltration.
